Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Tendios websites, applications and services (collectively, the "Service"), provided by Tendios S.L. ("Tendios"). By accessing or using the Service, you agree to these Terms.
1. Who can use the Service
The Service is intended for business use only. By creating an account you represent that you are at least 18 years old, authorised to act on behalf of the entity you register for, and not located in a jurisdiction where the Service is restricted by applicable law.
2. Accounts and access
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorised access. We may suspend or terminate access for violations of these Terms, legal obligations, or to protect other users.
3. Subscriptions and billing
Paid plans renew automatically for successive terms unless cancelled before the renewal date. Fees are billed in advance and are non-refundable except where required by law. We may change pricing on 30 days' written notice; changes take effect at your next renewal.
4. Acceptable use
You agree not to:
- Scrape, mirror, or bulk-export Service content except as expressly permitted.
- Reverse-engineer, probe for vulnerabilities, or disrupt the Service.
- Use the Service to send unsolicited communications, harass others, or violate applicable laws.
- Submit content that infringes third-party rights or contains malware.
- Circumvent rate limits, access controls, or plan entitlements.
5. Data and confidentiality
Personal data is processed according to our Privacy Policy. Content you upload remains your property; you grant Tendios a limited licence to host, process and display it solely to provide the Service. We never train our AI models on your private content.
6. Public data
Tendios aggregates procurement data from publicly available sources. This data is provided on an "as-is" basis. We make reasonable efforts to ensure completeness and accuracy but cannot guarantee the Service will surface every relevant notice. Official publications in their original sources remain authoritative.
7. Warranties and disclaimers
The Service is provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Nothing in the Service constitutes legal advice.
8. Limitation of liability
To the maximum extent permitted by law, Tendios' aggregate liability for any claim arising from the Service shall not exceed the fees paid by you for the Service in the 12 months preceding the event giving rise to the claim. Tendios is not liable for indirect, special, incidental or consequential damages.
9. Suspension and termination
You may cancel your subscription at any time from your account settings. We may suspend or terminate accounts that violate these Terms or pose a risk to the Service or other users. On termination, your access ends; data export is available for 30 days.
10. Governing law
These Terms are governed by the laws of Spain. Any disputes will be submitted to the exclusive jurisdiction of the courts of Barcelona, without prejudice to mandatory consumer protection rules in your country of residence.
11. Changes
We may update these Terms. Material changes will be notified at least 15 days in advance by email or in-product notice. Continued use after the effective date constitutes acceptance.
